What is Estate Planning?

Estate planning involves the creation of a set of legal documents that outline how your assets will be managed and distributed, and who will make critical decisions on your behalf if you are unable to do so. A comprehensive estate plan is tailored to your unique personal, family, and financial circumstances.
Key components of an estate plan typically include:

  • Your Will: The cornerstone of your estate plan, this document specifies how your assets are to be distributed to beneficiaries after your death and appoints an executor to carry out your instructions.
  • Enduring Power of Attorney: This document appoints a trusted person (your attorney) to make financial and legal decisions on your behalf if you lose the capacity to make them yourself.
  • Appointment of Enduring Guardian: This appoints a person (your guardian) to make important personal and healthcare decisions for you, such as where you live and what medical treatment you receive, if you become unable to decide for yourself.
  • Superannuation Binding Death Benefit Nominations: This ensures your superannuation benefits, which do not automatically form part of your estate, are paid directly to your nominated beneficiaries according to your wishes.

Our Secure Online Tool

For your convenience, you can begin the process of drafting your Will through our simple and secure online platform. This tool is designed to help you organise your thoughts and record your initial instructions at a time that suits you.

Please note: This is the first step in the process. Once you have submitted your information, one of our expert estate planning lawyers will contact you to review your instructions, provide tailored legal advice, and ensure the final document is legally valid and accurately reflects your wishes.

The Statutory Will

Fortunately, the law in New South Wales provides a solution for this difficult situation: The Statutory Will.

A Statutory Will is a Will that is made, altered, or revoked by the Supreme Court on behalf of a person who lacks testamentary capacity. An application can be made to the Court by a family member or another person who has a genuine interest in the individual’s welfare.

The Court will only approve a Statutory Will if it is satisfied that the proposed Will accurately reflects the intentions the person would have had if they were able to make the decision themselves. It is a complex legal application that requires specialist evidence and careful presentation. Our lawyers have the expertise to guide families through the Supreme Court application process with sensitivity and skill.
